Delaware Estate Tax Calculator

Estimate the federal estate tax on a Delaware decedent’s estate and confirm that Delaware itself charges nothing for deaths on or after January 1, 2023. Delaware repealed its state estate tax effective for those deaths, and has no inheritance tax or gift tax. Distinctive rules modeled: the repealed Delaware estate tax, spousal elective share (one-third), and small-estate affidavit. Three modes: estimate the tax, test a larger estate, or solve for the years of gifting needed to reach zero. Fields marked * are required; Calculate names any left empty.

Delaware rules this calculator enforces: state estate tax REPEALED for decedents dying on or after January 1, 2023 (Delaware 2022 legislation), so for 2024-2026 deaths Delaware estate tax is $0 and no Delaware estate tax return is filed; no inheritance tax; no gift tax; common-law (equitable distribution) state, not community property; spousal elective share of one-third of the estate (12 Del. C. 901); small-estate affidavit where personal property is $30,000 or less (12 Del. C. 2306; verify current figure); probate venue with the Register of Wills of the county of domicile (New Castle, Kent, Sussex).
Federal: unified estate and gift schedule topping at 40%; basic exclusion $13,610,000 (2024), $13,990,000 (2025), $15,000,000 (2026); federal portability (DSUE) allowed; unlimited marital and charitable deductions; GST 40%.

How it works

  • Delaware charges nothing for recent deaths. Delaware repealed its state estate tax effective for decedents dying on or after January 1, 2023, so for 2024-2026 deaths the Delaware estate tax is $0 and no Delaware estate tax return is filed. There is no Delaware inheritance tax and no Delaware gift tax.
  • Only federal transfer taxes apply. The federal estate tax applies above the basic exclusion using the unified 18% to 40% schedule, and the federal GST applies at 40% to direct skips above the allocated GST exemption.
  • No community property. Delaware is a common-law state, so no halving of community assets and no double basis step-up.
  • Portability is federal only. A surviving spouse may inherit the unused federal exclusion (DSUE) with a timely Form 706 election; there is no Delaware state exclusion to port.
  • Elective share. A surviving spouse may elect one-third of the estate under 12 Del. C. 901 regardless of the will.
  • Small estates skip full probate. The affidavit procedure under 12 Del. C. 2306 is available where personal property is $30,000 or less; verify the current figure.
  • Binding factor names what controls the result: the federal basic exclusion, the federal unified schedule above it, or the GST.
  • Gifting mode uses the guarded bisection solver (60 expansions, 90 iterations, rounded up) to find the years of annual-exclusion gifting that bring the taxable estate to the exclusion or below.
  • Gifting is not free. Carryover basis loses the step-up; the deferred gain is netted against the tax saved.

What Is a Delaware Estate Tax Calculator?

A Delaware Estate Tax Calculator estimates transfer taxes for a Delaware estate from the assets, deductions, bequests, gifts, and portability information you enter. Delaware estate tax and inheritance tax are fixed at $0 for the supported 2024 through 2026 deaths. The main tax calculation is federal, with a separate federal GST calculation for direct skips.

The tool helps executors, surviving spouses, families, and estate owners see whether the federal tax base exceeds the selected exclusion. It also shows gross estate, taxable estate, exclusion headroom, tax, net to other heirs, elective share, affidavit status, and a Form 706 indicator.

In short, the calculator adds estate assets, subtracts modeled deductions and eligible bequests, adds earlier taxable gifts to the federal base, and compares that amount with the applicable federal exclusion. If the base is higher, it calculates federal estate tax from the coded progressive schedule. Delaware tax remains $0.

How the Delaware Estate Tax Calculator Formula Works

The calculation begins with five asset groups. These are real property, financial accounts, retirement accounts and annuities, life insurance owned by the decedent, and business interests or other property.

Gross Estate=R+F+Ret+L+B\text{Gross Estate}=R+F+Ret+L+B

Administration costs are calculated from the entered attorney and personal representative fee percentage plus court costs. The percentage applies to gross estate minus debts, but never to a negative amount.

Administration=max⁡(Gross−Debts,0)×Fee %100+Court Costs\text{Administration}=\max(\text{Gross}-\text{Debts},0)\times\frac{\text{Fee \%}}{100}+\text{Court Costs}

The calculator subtracts debts, funeral costs, administration costs, and casualty or theft losses. Net estate cannot fall below zero. A marital deduction applies only when the decedent is marked married and the spouse is a U.S. citizen or the bequest uses a QDOT. The charitable deduction is capped at the remaining estate.

Taxable Estate=max⁡(Net Estate−Marital Deduction−Charitable Deduction−Gift Reduction,0)\text{Taxable Estate}=\max(\text{Net Estate}-\text{Marital Deduction}-\text{Charitable Deduction}-\text{Gift Reduction},0)

The federal tax base equals taxable estate plus earlier taxable gifts. The applicable federal exclusion equals the selected year’s basic exclusion plus entered DSUE. Below that amount, federal estate tax is $0. Above it, the calculator subtracts schedule tax on the exclusion from schedule tax on the federal base.

Federal Estate Tax=S(Federal Base)−S(Applicable Exclusion)\text{Federal Estate Tax}=S(\text{Federal Base})-S(\text{Applicable Exclusion})

Here, S means the coded federal progressive schedule, which runs from 18% through 40%. The formula is applied only when the federal base is above the applicable exclusion. Federal GST tax is calculated separately at 40% of direct skips above the GST exemption entered by the user.

GST Tax=0.40×max⁡(Direct Skips−GST Exemption,0)\text{GST Tax}=0.40\times\max(\text{Direct Skips}-\text{GST Exemption},0)

Example: for a 2025 estate, enter $4,000,000 of real property, $3,000,000 of financial assets, $2,000,000 of retirement assets, $400,000 of debts, $15,000 of funeral costs, a 2% fee, and $400 of court costs. Gross estate is $9,000,000. Administration is $172,400. Total deductions are $587,400, leaving $8,412,600. With no other adjustments, that is below the $13,990,000 federal exclusion, so federal and Delaware estate tax are both $0.

How to Use the Delaware Estate Tax Calculator: Step by Step

  1. Choose a mode: estimate tax, test a larger estate, or solve for years of annual-exclusion gifting needed to reach zero calculated tax.
  2. Select the year of death and the Delaware county of domicile. The year sets the federal exclusion and annual gift exclusion. The county sets the Register of Wills venue shown in the results.
  3. Enter assets at date of death: real property, financial accounts, retirement assets, owned life insurance, and business interests or other property.
  4. Enter debts and costs, including funeral expenses, the administration fee percentage, Register of Wills costs, and casualty or theft losses.
  5. Complete the marital and bequest fields that apply, including spouse citizenship, QDOT status, spousal bequest, and charitable bequests.
  6. Enter earlier taxable gifts, DSUE, direct skips, and GST exemption when relevant. In gifting mode, also complete the donee, gift, gain, tax-rate, NIIT, and maximum-year fields.
  7. Check the acknowledgment and calculate. Review total transfer tax, then the detailed federal tax, Delaware tax, GST, deductions, filing, heir, and gifting results.

The output is an estimate based on entered values and coded rules. A $0 Delaware tax result does not mean every estate has no tax or filing issue. Federal estate tax, GST tax, probate requirements, and other matters may still apply.

What Your Delaware Estate Tax Calculator Result Means

Federal Exclusions and Gift Limits Used by the Tool

Year of DeathFederal Basic ExclusionAnnual Gift Exclusion per DoneeDelaware Estate Tax
2024$13,610,000$18,000$0
2025$13,990,000$19,000$0
2026$15,000,000$19,000$0

The calculator adds entered DSUE to the federal basic exclusion. It creates no Delaware exclusion because Delaware estate tax is set to $0 for the modeled years. Earlier taxable gifts are added to the federal base, while Delaware inheritance tax remains $0.

Marital Deduction, Elective Share, and Small Estates

A spousal bequest is deducted only when the married box is checked and the spouse is a U.S. citizen or a QDOT is selected. The deduction cannot exceed net estate. For a married decedent, the elective-share output equals one-third of net estate. Years married does not change that formula.

The small-estate indicator compares personal property with $30,000. It adds financial accounts, retirement assets, life insurance, and business or other property. Real property is excluded. The selected county sets the Register of Wills venue.

How Gifting Mode Is Modeled

For each donee, the calculator uses the smaller of the entered gift and annual exclusion. It multiplies that amount by donees and years. Amounts above the annual exclusion do not create extra solver reduction and are not added automatically to earlier taxable gifts.

The solver tests years until total transfer tax reaches zero or the maximum period is reached. It uses expansion and bisection, then rounds up to a whole year. The tool also shows tax after one, two, and three years.

Important Limitation in the Current Gifting Output

The form accepts unrealized gain, a long-term capital-gains rate, and a 3.8% NIIT choice. However, the result object does not pass the gain value into the rendering step. As coded, deferred capital-gains cost and net benefit can therefore display $0 instead of reflecting the entered gain.

This is a tax estimate, not professional advice. Actual results can vary because of asset values, ownership, deductions, prior gifts, elections, filing rules, law changes, and facts the calculator does not capture. Confirm important planning or filing decisions with current law and a qualified professional.

Frequently Asked Questions

Does Delaware have an estate tax in this calculator?

No. The calculator sets Delaware estate tax to $0 for every supported death year: 2024, 2025, and 2026. It also sets Delaware inheritance tax to $0. The main estate tax calculated by the tool is federal estate tax, with a separate federal GST calculation when taxable direct skips are entered.

What federal estate tax exemption does the calculator use?

The calculator uses $13,610,000 for 2024, $13,990,000 for 2025, and $15,000,000 for 2026. Entered DSUE is added to that basic exclusion. The tool then compares the resulting applicable exclusion with taxable estate plus earlier taxable gifts when determining whether federal estate tax is due.

How does DSUE affect the Delaware estate tax estimate?

DSUE increases only the federal applicable exclusion in this calculator. The entered DSUE amount is added directly to the selected year’s federal basic exclusion before federal estate tax is tested. Delaware has no separate estate-tax exclusion in the modeled years because the code sets Delaware estate tax to zero.

How does the calculator handle gifts made before death?

Earlier taxable gifts entered in the federal-base field are added to the taxable estate when calculating the federal tax base. Gifting mode is different. It models annual-exclusion gifting by reducing the taxable estate by the allowed gift amount per donee for each tested year, subject to the coded annual exclusion.

Does the calculator include generation-skipping transfer tax?

Yes. It calculates federal GST tax at 40% of direct skips that remain after subtracting the GST exemption amount entered by the user. The GST exemption input defaults to $0, so the calculator does not automatically fill the federal exclusion into that field even though the helper text describes that relationship.

How does the Delaware small-estate affidavit check work?

The calculator marks the estate as affidavit eligible when personal property is $30,000 or less. Its personal-property formula adds financial accounts, retirement assets, life insurance, and business or other property. Real property is excluded from that test. The result also identifies the Register of Wills venue for the selected Delaware county.

How accurate is the Delaware Estate Tax Calculator?

The calculator follows the formulas and assumptions in its code, so it can be useful for estimates and scenario testing. It does not perform a full estate tax return or legal analysis. Actual tax can differ because of valuations, elections, deductions, ownership structures, law changes, filing rules, and other estate-specific facts.
